Expungement and Sealing of Criminal Records

Maryland, Virginia, and Washington, DC

"Expungement" is the term often used for the process of removing from public access the official records of arrests or criminal convictions. Expungement offers individuals a "clean slate" by giving them the opportunity to put past criminal offenses or arrests behind them. Some jurisdictions, such as District of Columbia, call this process "sealing" instead of "expungement." Each state and the District of Columbia has different rules for what charges can be expunged, whether convictions can be expunged, whether there are waiting periods before an individual can seek to have his record expunged, etc.

Expungement Eligibility

  • Washington, District of Columbia.

In District of Columbia, the law allows for sealing records of arrests for misdemeanors and felonies that did not result in a conviction. It also permits the sealing of some misdemeanor convictions.

  • Maryland.

We also handle expungement cases in Maryland. Maryland law permits arrests not leading to a guilty finishing and Probation Before Judgment (PBJ) cases to be expunged. Maryland does not currently expunge any convictions unless they are crimes that have been pardoned by the Governor or reversed on appeal.

  • Virginia.

Virginia also does not currently expunge convictions unless they have been pardoned by the Governor or reversed on appeal. In Virginia, it is generally more difficult to get records expunged, even when you are eligible, but many times it is still possible.
